All businesses selling beer or wine must obtain a business license. No other type of business is required to obtain a license.

An outdoor seating permit allows businesses to serve customers at tables outside on the public sidewalk and in public space. These conditions apply:

• Tables must be placed directly next to the business’s storefront.
• Tables must belong to the business.
• Seating areas must be clearly delineated.
• A 5-foot path must be available that leads to the business's front door and that complies with the Americans with Disabilities Act.
• A 6-foot clear pedestrian path must be maintained along sidewalks.

Mobile food vendors must have operating permits from the town and the Orange County Health Department. Vendors include pushcart and food truck operators. Regulations apply to those who intend to operate from a fixed location or through a route multiple days per year.

The town permits a specific number of food trucks within its limits for more permanent operations. Permits are issued on a first-come, first-served basis until all available permits have been issued.

Mobile food vendors are required to make food and beverage tax payments:

Monthly Compliance — Vendors working in a more permanent basis must file a report each month regardless of sales.

Single-Day Compliance — Nonprofit organizations and merchants selling prepared food or beverages in temporary locations must submit an application and prepay for each day of operation.

Tax Rates and Compliance

Properties that discharge greasy wastewater are required to have interceptors for fats, oil and grease to keep these materials out of plumbing and sewer lines. Over time, this waste can cause sewer backups or overflows.
